Terms of sale

1. Preamble

These Terms and Conditions of Sale are entered into between:

  • Pyrène Performance, a SAS registered with the Toulouse Trade and Companies Register (RCS) under number Toulouse B 935 289 678 , whose registered office is located at 11 rue des Filatiers, 31000 Toulouse, France (hereinafter « Pyrène Performance » or « We »),

  • and any natural or legal person making a purchase via the Site (hereinafter « the Customer » or « You »).
     

The purpose of these Terms and Conditions of Sale is to define the rights and obligations of the parties in connection with the sale of products or services on the Site.
 

2. Products and Offers

2.1. Product presentation

The products sold on the Site are described and presented with the greatest possible accuracy. However, the photographs, illustrations and descriptions are not contractually binding and are provided for information purposes only. Pyrène Performance may not be held liable for minor differences between the online presentation and the product delivered (e.g.: variation in colour, packaging or non-essential features).
 

2.2. Product availability and stock management

Product offers are valid as long as they are visible on the Site and while stocks last.

If a product is unavailable after the order has been confirmed, Pyrène Performance undertakes to inform the Customer as soon as possible. The Customer may then, at their choice:

  • Opt for a replacement product of equivalent or higher value (with their prior agreement),

  • Wait until the product is restocked if a time frame is indicated,

  • Cancel the order for the product concerned and receive a full refund of the corresponding amount.
     

In the event of a total or prolonged stock shortage, Pyrène Performance may not be held liable for the impossibility of supplying the product, provided that it has informed the Customer within the applicable time frame.
 

2.3. Modification of offers

Pyrène Performance reserves the right to modify or withdraw, at any time, the products offered on the Site, without notice and without incurring any liability towards Customers.
 

2.4. Product prices

The prices displayed on the Site are in euros (€), all taxes included, excluding delivery charges. Pyrène Performance reserves the right to change its prices at any time, but products will be invoiced on the basis of the rates in force at the time the order is confirmed.

In the event of an obvious error in the displayed price (e.g.: a price significantly lower than the actual value of the product for a technical reason), Pyrène Performance reserves the right to cancel the corresponding order, provided that it informs the Customer as soon as possible.
 

2.5. Personalised or specific products

For personalised or made-to-order products, no cancellation or modification of the order will be possible after confirmation, except with the express agreement of Pyrène Performance. These products are neither exchangeable nor refundable, except in the event of a lack of conformity or a proven defect.
 

2.6. Use of products

The products offered comply with the French legislation in force and are intended for personal, non-commercial use. Pyrène Performance declines all liability in the event of use that does not comply with the recommendations or intended uses.
 

3. Order
 

3.1. Order process

To place an order, the Customer must:

  1. Select the products and add them to the basket,

  2. Confirm the contents of the basket,

  3. Create an account or log in,

  4. Choose the delivery method and accept these Terms and Conditions of Sale,

  5. Proceed to secure payment.

Confirmation of the order constitutes unreserved acceptance of these Terms and Conditions of Sale.
 

3.2. Order confirmation

A confirmation e-mail setting out the details of your order will be sent to the e-mail address provided when the order was placed. Pyrène Performance reserves the right to refuse or cancel any order in the event of non-payment, suspected fraud or an ongoing dispute with the Customer.
 

3.3. Order and Pre-order

In the event of a Pre-order, the sums paid in advance by the Customer do not constitute a deposit (« arrhes ») within the meaning of article 1590 of the Code Civil (French Civil Code). Any Pre-order is firm and final, except where the right of withdrawal is exercised within a period of fourteen (14) days in accordance with the applicable legal provisions.

If the minimum target for a Pre-order campaign is not reached, Pyrène Performance will contact the Customer at the end of the campaign to inform them of its decision to refund or to produce. In the event of cancellation of the Pre-order due to the target not being reached, Pyrène Performance will refund in full the sums paid by the Customer within a period of fourteen (14) days from the notification of this cancellation.

In the event of cancellation for any other reason, Pyrène Performance also undertakes to refund the sums paid within a period of fourteen (14) days, without the Customer being able to claim any damages or additional compensation.

Delivery times for pre-ordered products are indicative. Pyrène Performance may not be held liable for delays related to production or logistical constraints or other exceptional circumstances.

When a discount (of any type) is applied to an order, it applies uniformly to all the products in the order. In the event of a total or partial return of the goods, the portion of the price paid by discount voucher will not be refunded.

Pyrène Performance may not be held liable for delays, modifications or cancellations of Pre-orders resulting from unforeseen circumstances or circumstances beyond its control, in particular in the event of force majeure.
 

4. Payment
 

4.1. Methods of payment

Purchases are paid for online, via one of the secure payment methods offered on the Site:

  • Bank card (Visa, Mastercard, American Express);

  • PayPal;

  • Any other method specifically offered on the Site.

Payment is due in full at the time of the order. The products remain the property of Pyrène Performance until full payment of the price (see article 7.1).
 

4.2. Validation and security of payments

All transactions carried out on the Site are secured using an SSL (Secure Socket Layer) encryption system. Pyrène Performance does not retain any banking data and relies on payment providers compliant with the PCI-DSS (Payment Card Industry Data Security Standard) standards.
 

If payment is refused by the banking institution or the payment provider, the order will be automatically cancelled, without incurring any liability on the part of Pyrène Performance.
 

4.3. Suspension or cancellation for non-payment

Pyrène Performance reserves the right to suspend or cancel any order in the event of:

  • Total or partial non-payment;

  • Refusal of payment authorisation by the Customer's financial institution;

  • Suspected fraud or fraudulent payment.

Any attempted fraud or non-payment will give rise to legal proceedings and to the immediate enforceability of all sums due.

Pyrène Performance reserves the right to suspend or cancel any Order or Pre-order and any delivery in the event of refusal of bank card payment authorisation by the officially accredited institutions or in the event of non-payment. Six et Sept reserves in particular the right to refuse to make a delivery or to honour an Order or Pre-order from a Customer who has not fully or partially paid for a previous order or with whom a payment dispute is ongoing.
 

4.4. Payment by direct debit or in instalments (where applicable)

If Pyrène Performance offers payment in several instalments or by direct debit, the Customer undertakes to comply with the payment schedule. In the event of a payment incident or a rejected direct debit, Pyrène Performance may:

  • Terminate the contract unilaterally and demand immediate payment of the remaining balance due;

  • Apply late-payment penalties calculated at the applicable legal rate from the due date of the rejected payment.
     

4.5. Fraud-protection reservation

To prevent fraud, Pyrène Performance reserves the right to ask the Customer for additional documents (e.g.: proof of identity, proof of address) to validate the order. The order will be suspended pending these documents. If the documents are not provided within a reasonable time or if inconsistencies are noted, Pyrène Performance may cancel the order and refund the amount paid, where applicable.
 

4.6. Currency and additional charges

All transactions are carried out in euros (€). Currency conversion fees or other banking charges related to the payment are borne exclusively by the Customer.
 

4.7. Non-payment

In the event of non-payment after delivery (in exceptional cases where deferred payment has been granted), late-payment penalties will be applied at the legal rate in force, without prejudice to additional costs for the recovery of the debt. Pyrène Performance may also suspend or cancel any order in progress until full payment of the sums due.
 

4.8 International payment methods

Payments made in a currency other than the euro (€) may result in conversion fees imposed by the Customer's financial institution. Pyrène Performance declines all liability in this regard.

VAT & Global Tax Policy: The prices displayed on the Site include French VAT. For international orders, local taxes or customs duties may apply and are borne exclusively by the Customer.
 

5. Delivery
 

5.1. Delivery methods

The products are delivered to the address indicated by the Customer when placing the order. It is the Customer's responsibility to provide an accurate and complete address. Pyrène Performance may not be held liable in the event that delivery is impossible due to an error or omission in the information provided by the Customer.

Delivery charges and times are specified at the time of the order. These times are indicative and depend on the carriers. Pyrène Performance may not be held liable for delays attributable to the carrier or to external circumstances (strikes, weather conditions, etc.).
 

5.2. Receipt and inspection of products

It is the Customer's responsibility to check the condition of the products upon receipt in the presence of the carrier. In the event of visible damage (damaged packaging, missing or damaged product), the Customer must make precise and detailed reservations on the delivery note or any other document provided by the carrier.

These reservations must be confirmed in writing to the carrier within a period of 48 working hours, in accordance with article L. 133-3 of the Code de commerce (French Commercial Code), and a copy of this claim must be sent to Pyrène Performance within the same period. Failing this, no claim relating to damage occurring during transport can be accepted.
 

5.3. Liability in the event of delay or non-delivery

Pyrène Performance undertakes to make every effort to comply with the announced delivery times, but may not be held liable for delays attributable to the carrier, to the Customer (e.g.: absence at the time of delivery), or to a case of force majeure. In the event of a delay or non-delivery, Pyrène Performance undertakes to investigate with the carrier. This process may take several days before a solution is proposed (re-shipment or refund, as the case may be).
 

5.4. Force majeure and unforeseen events

Pyrène Performance may not be held liable for delays or impossibilities of delivery due to cases of force majeure or to unforeseen events beyond its control (pandemics, strikes, natural disasters, etc.). In such situations, Pyrène Performance undertakes to inform the Customer as soon as possible and to propose a suitable solution (postponement of delivery, refund, or other).
 

5.5. Unclaimed parcels

If a parcel is returned to Pyrène Performance because it was not claimed by the Customer from the carrier or the pick-up point within the allotted time, the costs of return and of any re-shipment will be borne by the Customer. If the Customer prefers to cancel the order after the parcel has been returned, Pyrène Performance will refund the amount of the order excluding delivery charges.
 

5.6 International Delivery Conditions For deliveries outside France, the Customer is responsible for any customs duties, local taxes or other additional charges imposed by the local authorities. The delivery times indicated for international orders are purely indicative and may vary depending on customs formalities.
 

6. Right of Withdrawal and Returns

6.1. Right of withdrawal

In accordance with the applicable legal provisions, the Customer has a period of fourteen (14) calendar days from receipt of their order to exercise their right of withdrawal, without having to give reasons or to bear any penalties.

However, the right of withdrawal does not apply to products that have been opened, used or whose original packaging has been damaged, in particular for reasons of health or hygiene (e.g.: food products).
 

6.2. Return procedures

To exercise their right of withdrawal, the Customer must notify their decision to Pyrène Performance by e-mail to contact@pyrene-performance.com or by post to the address indicated.

The products must be returned in their original condition, unused, complete (packaging, accessories, etc.), and in perfect resalable condition. Failing this, Pyrène Performance reserves the right to refuse the refund. Return costs are borne by the Customer, except in the event of a non-conforming or defective product.
 

6.3. Non-conforming or defective products

In the event of a non-conforming product or one with a proven defect, Pyrène Performance will, at its choice, replace the product or issue a refund, provided that the Customer reports the problem within a period of seven (7) days following receipt. Pyrène Performance may require proof of the defect or non-conformity, such as photographs, before accepting a return.
 

6.4. Refund

Refunds will be made within a maximum period of fourteen (14) days after receipt of the returned products, subject to their conformity with the conditions set out above. The refund will be made using the same payment method as that used for the order. The initial delivery charges are not refundable, except in the event of an error attributable to Pyrène Performance.
 

6.5 Return policy for international sales For international orders, the Customer is responsible for the return costs, except in the event of a defective or non-conforming product. Pyrène Performance will not cover any customs fees or taxes related to the return of the products. For orders placed outside the European Union, the right of withdrawal may not apply, depending on the Customer's local legislation. We invite international Customers to check the rules applicable in their country before placing an order.
 

7. Ownership and Risks
 

7.1. Retention of title

The products remain the exclusive property of Pyrène Performance until full payment of their price, including any applicable fees and taxes. In the event of total or partial non-payment, Pyrène Performance reserves the right to claim the return of the products, at the Customer's expense, without prejudice to any other legal action.
 

7.2. Transfer of risk

The transfer of risk to the Customer takes place as soon as the products are handed over to the carrier. Consequently, Pyrène Performance may not be held liable for damage or loss occurring during transport. It is the Customer's responsibility to carefully check the condition of the products upon receipt and to make any reservation or claim to the carrier within the allotted time (generally 48 hours). In the absence of explicit reservations, the products will be deemed to be in conformity and free from any apparent defect.
 

7.3. Inspection of products on delivery

The Customer undertakes to check the integrity and conformity of the products upon receipt. Any claim relating to a missing, damaged or non-conforming product must be reported to Pyrène Performance within a period of three (3) working days following receipt, accompanied by tangible evidence (photographs, description of the damage, etc.). After this period, no claim can be taken into account.
 

7.4. Return of defective products

In the event of a proven defect falling within the responsibility of Pyrène Performance (excluding damage due to transport), the Customer may request, after validation by our services, the replacement or refund of the product. Pyrène Performance reserves the right to refuse any request if the product has been used or damaged after its receipt by the Customer.
 

7.5. Exclusion of liability for misuse

Pyrène Performance declines all liability in the event of damage resulting from misuse, inappropriate storage, or handling of the products by the Customer.
 

8. Liability

Pyrène Performance makes every effort to guarantee the quality and conformity of its products, but its liability may not be engaged in the following cases:
 

8.1. Non-compliant use

Pyrène Performance declines all liability in the event of damage resulting from use of the products that does not comply with the usage recommendations or in the event of non-compliance with the dosages and usage protocols mentioned on the Site or on the packaging.
 

8.2. Force majeure

Pyrène Performance cannot be held liable for delays or failures in delivery due to cases of force majeure, as defined by article 1218 of the Code civil (French Civil Code) and French case law (strikes, natural disasters, pandemics, etc.).
 

8.3. Food products

The products offered comply with the French legislation in force. Pyrène Performance may not be held liable for any adverse effects in the event of an allergy, intolerance or specific medical condition not previously reported by the Customer. It is the Customer's responsibility to consult the composition of the products before consuming them and, if necessary, to seek advice from a healthcare professional.
 

8.4. Limitation of liability

The total liability of Pyrène Performance, in connection with an order, may not exceed the total amount paid by the Customer for the products concerned. Under no circumstances will Pyrène Performance be liable for indirect damage, loss of profit, loss of data or other inconveniences resulting from the use of the products or the Site.

Pyrène Performance declines all liability in the event of non-conformity of the products or services with the local legislation applicable in the country of destination, unless a mandatory provision to the contrary applies.
 

9. Protection of Personal Data

The personal information collected during the use of the Site or the placing of an order is processed in accordance with our Data Protection Policy, available [here](link to the policy).

Pyrène Performance undertakes to respect the confidentiality of the data provided by the Customer. In accordance with the General Data Protection Regulation (GDPR), you have rights of access, rectification, objection, erasure and portability of your data. For users residing outside the European Union, personal data will be processed in accordance with the GDPR, unless otherwise provided by the applicable local legislation.
 

10. Applicable Law and Disputes

These Terms and Conditions of Sale are governed by French law. In the event of a dispute, the parties undertake to seek an amicable solution before referring the matter to the competent courts of Toulouse.

These Terms and Conditions of Sale are governed by French law. However, for consumers residing outside France, the mandatory provisions of their local consumer-protection legislation will prevail, where the latter are more favourable.
 

10.1 Language and translation of the Terms and Conditions of Sale

These Terms and Conditions of Sale are drafted in French. In the event of translation into another language, only the French version shall prevail in the event of a dispute or interpretation.


11. Modifications to the Terms and Conditions of Sale

Pyrène Performance reserves the right to modify these Terms and Conditions of Sale at any time. The new Terms and Conditions of Sale will be applicable as soon as they are published on the Site and to all subsequent orders.
